Leave & Working Hours Policy

(A) Leave Guidelines

1. Objective

The objective of the leave policy is to enable employees to be engaged and productive at work by ensuring adequate work-life balance for the employees and time to attend/take care of personal emergencies/exigencies.

2. Scope & Applicability

This policy covers all full-time employees of Kiara TechX.

3. Eligibility & Types of Leaves

All employees are eligible for leaves. All leaves are calculated on a calendar year basis i.e. from 1st January to 31st December. Employees are eligible for different types of leave benefits depending on their personal needs. The leave benefits available to employees may be categorized as:

  • 3.1 Public Holidays
  • 3.2 Personalized Leaves
  • 3.3 Marriage Leaves
  • 3.4 Parental Leaves
  • 3.5 Compensatory Leave
  • 3.6 Advance leave
  • 3.7 Leave without Pay

3.1 Public Holidays

  • The company observes certain paid statutory and public holidays notified and published by the Government of India and State Governments as per Shop & Commercial Establishment Acts which are issued by the ministry of respective state governments
  • The company shall observe 8-10 such holidays during the calendar year. The list of 8-10 fixed holidays will be stipulated by the Human Resources Department, declared and communicated at the beginning of the calendar year. The Human Resources Department reserves the right to effect amendments to the published list of public holidays after communicating in advance. 3.2 Personalized Leaves

  • All employees are eligible to get 18 days of leaves for the purpose of vacation or personal time off. Leaves can also be utilized for medical needs; family emergencies etc.
  • Employees receive 1.5 leaves credited at the beginning of each month (January - December), totaling 18 leaves per year, and can take advance leaves. If an employee leaves before year-end, their eligible leaves are based on months worked. For example, if they leave in March, they qualify for 4.5 leaves. If they have taken 6 leaves, the excess 1.5 leaves will be deducted from their final settlement.
  • New joiners to Kiara TechX will get the leaves on a pro-rata basis from the date of joining.
  • For calculation purposes, anyone joining that falls between the 1st to 15th of the month will get full leave credit for that month.

3.3 Marriage Leave

  • Kiara TechX grants employees 5 days of special marriage leave, to be taken around their actual marriage date. This leave is not automatically provided; employees must request HR to add it to their leave balance, and it requires approval from their manager.

3.4 Parental Leaves

3.4.1 Maternity Leave
  • Expecting mother employees, who have worked continuously for a period of at least 80 days during the immediate 12 months preceding the date of expected delivery, are entitled to maternity leave as per Maternity Benefit Act, 1961 whether taken before or after delivery.
  • The employee should indicate the dates on which she would like to start her maternity leave and the date she desires to resume. Typically, the maternity leave can start 8 weeks prior to delivery and end on completion of 18 weeks after delivery. However, the employee can choose to work as long as she deems fit prior to the date of delivery and the 26 weeks will be counted from the date she actually goes on maternity leave.
  • Those proceeding on ML will be paid a full salary during the period. Employees are, however, entitled to avail of maternity leave for a maximum of two times during their tenure with the Company.
  • In case of miscarriage or medical termination of pregnancy, an employee can avail of paid leave up to 6 weeks under the Maternity Benefit Act, 1961, starting from the day of miscarriage or termination.
  • In case of maternity leave, employees are required to apply for leaves at least 3 months in advance of the expected date of delivery.
3.4.2 Paternity Leave
  • To enjoy Fatherhood, employees will be entitled to 5 working days of paid paternity leave at the time of birth of their child.

3.5 Compensatory Leave

  • If an employee works additional hours beyond their regular working hours, they may request compensatory time-off (comp-off). This is especially applicable in situations where clients require urgent attention or extended project hours. To request a comp-off, the employee must inform their manager via email, explaining the situation and the additional hours worked, with a copy sent to HR for record-keeping. The manager will review and approve the request based on project needs, client requirements, and team workload. Approved comp-off hours should be utilized before the end of the calendar year, and employees must coordinate with their manager to ensure minimal disruption to work. Comp-off is not applicable for non-billable hours unless the manager and HR make an exception for special cases. This policy makes sure employees are treated fairly while keeping work on track and clients happy.

3.6 Advance Leave

  • Employees can also apply for advance leaves within the 18 days leaves anytime during the year to meet any personal exigencies. This is subject to business scenarios and approvals from the manager.

3.7 Leave without pay (LWP)

  • If an employee has no paid leave left and needs time off for an urgent reason, they can apply for LWP (Unpaid Leave). They must get permission from their manager to take LWP.

4. Other Guidelines

Leaves are calculated based on the number of working days taken off from work. Any weekends or holidays that are either prefixed or suffixed to the leave period, as well as those falling in between the leave period, will not be counted as leave days. However, this does not apply to maternity leaves, where the entire leave period is counted, including weekends and holidays.

Clubbing of Leaves

  • Employees may club Earned Leave with other leaves.
  • Leave encashment is not applicable.

Leave during Notice Period

  • Employees cannot take leave during the notice period except for medical reasons or extreme personal circumstances. The employee’s manager may decide to extend the notice period by the number of days an employee takes leave during the notice period.

(B) Working Hours guidelines:

  1. Office timings at Kiara TechX will be flexible, the shift duration will be 9 Hours per day including 45 mins Break.
  2. Every Month weekly offs will be on all Saturdays and all Sundays.
  3. For any emergency or leaving office during working hours, if the employee works for less than 4.5 hours won't be marked under attendance. To avail half day, at least an employee has to work for 4.5 hours or more.
  4. To mark any day under full-day presence an employee will need to work for a minimum of 6 hours. Also taking this flexibility into account any employee has to work 41 hours(Monday to Friday) at the end of the week.

Management Rights

The Management reserves the absolute right to amend, suspend or withdraw any or all the provisions of this policy at any time with or without prior notice to the employees. In case of any ambiguity on the interpretation of any of the provisions contained herein, the interpretation given by such an authorized officer of the company shall be final and binding.
